01. Introduction

The following Privacy policy (hereinafter referred to as "Policy") sets out clear guidelines for how Kiombo (hereinafter referred to as "Kiombo", "we", "our", "ours" and "us") collects, uses, discloses, stores, protects and otherwise processes any personally identifiable information (hereinafter referred to as "Personal Information") that you (hereinafter referred to as "you" and "your") give us through the website www.kiombo.com (hereinafter referred to as "Website"). And because we take your right to privacy very seriously, we shall treat your Personal Information lawfully, fairly, and in a transparent manner.

This Policy complies with the terms of the EU General Data Protection Regulation 2016/679 ("GDPR"), and shall form an integral part of the General terms of sale of the Website. For the purposes of applicable data protection laws and this Policy, we are responsible as "data controller" of your Personal Information.

By using/accessing the Website and/or submitting your Personal Information to us, you acknowledge that you have read and understood this Policy and unconditionally agree to be abide and be bound by the provisions of this Policy.

In case of any discrepancy between the meanings of any translated versions of this Policy, the meaning of the English Language version shall prevail.

Credit card transactions are processed through payment gateway providers such as PayPal, which means we do not process or store any financial sensitive data. We do not sell, trade, rent, distribute or disclose your Personal Information to third parties for their marketing and advertising purposes without your express consent.

06. Retention of Personal Information

We will only retain your Personal information for as long as necessary for the purposes set out in this Policy, including for the purposes of satisfying any legal, regulatory or accounting requirements.

If you have not accessed your customer account for more than three hundred and sixty-five (365) days, we may terminate it without notice, along with any Personal Information we hold about you.

We are committed to protecting the confidentiality and security of your Personal Information we process.

We have implemented reasonable and appropriate administrative, legal, organizational, and technical measures in an effort to protect the Personal Information in our custody or control against theft, loss, and unauthorized access, use, modification, and disclosure. 09. Destruction of Personal Information

Once your Personal Information is no longer required, we will take all reasonable steps to delete your Personal Information from our server and files.

10. Emails

We fully comply with applicable applicable anti-spam laws. You can always opt out of receipt of further email correspondence from us.

Please note that we will never ask you to disclose your Personal Information in an unsolicited phone call, letter, fax or email, whatever the situation. If you receive an unsolicited call, letter, fax or email that claims to be from us, requesting your customer account details and other Personal Information, do not respond.

11. Children

We understand the importance of protecting children's privacy, especially in an online environment. While the Website is designed for a general audience, we do not knowingly collect Personal Information from children under the age of sixteen (16) without verifiable prior parental or legal guardian consent. If you have reason to believe that we have collected Personal Information concerning a child under sixteen (16), please let us know immediately, and we will take the necessary and appropriate measures to delete such data from our records.

15. Applicable law and jurisdiction

This Policy shall be governed by, construed and interpreted in accordance with, the laws of Portugal without regard to conflicts of laws principles. Any disputes directly or indirectly arising out of or relating to this Policy will be irrevocably submitted to the exclusive jurisdiction of the Courts of Lourinhã, in the District of Lisbon, Portugal.

We reserve the right in our sole discretion to modify this Policy at any time without prior notice.

Any adjustment to this Policy will be posted on the Website and shall be deemed to be in force from its date of promulgation. It is your responsibility to check for any such changes.
